Strict Enforcement of the Child Safety in Motor Vehicles Act Postponed by DOTr



The Child Safety in Motor Vehicle Act

The Child Safety in Motor Vehicle Act or the RA 11229 is an approved law signed by President Duterte on February 22, 2019. The said law disallows children twelve (12) years old and below who are shorter than 4’11 from sitting in the front passenger seat of the vehicle. Also according to the law, children must not be left unattended within a private vehicle.

Moreover, the RA 11229 also requires children to use Child Restraint Systems (CRS) or child car seats that are appropriate for their age, height, and weight while within a private vehicle. Car seats to be installed in private vehicles should be those that are approved by the Department of Trade and Industry (DTI).

“The safety of our children is a matter of state policy that is pursued and enshrined as their right to be protected. It is why measures such as Republic Act 11229 or the Child Safety in Motor Vehicles Act was passed and signed AS LAW.”

The Implementation of the Law

The implementation of the Child Safety in Motor Vehicle Act was discussed by the Deputy Director of the Law Enforcement Service of the Land Transportation Office (LTO), Robert Valera, through a virtual press conference that went live on January 29, 2021. And it was said to take effect on February 2, 2021.
Valera however noted, “We’ll come up with a timeline. Between three (3) months to six (6) months, that’s when we will start our enforcement or apprehension of violators.”

Furthermore, on February 2, 2021, the Department of Transportation (DOTr) of the Philippines stated that LTO Chief Assistant Secretary (Asec.) Edgar C. Galvante has also clarified that, in the meantime, there will be no strict enforcement of the law.
“…instead of apprehensions, the Agency will focus on information dissemination about the new law, in coordination with other government agencies such as the Philippine Information Agency, the Department of Education, the DTI, and the private sector.”

DOTr Defers Strict Enforcement of the Law

And today (Wednesday), February 3, 2021, the DOTr has bared that they, together with the Land Transportation Office (LTO), have agreed that before they can fully implement the law, there should be a massive information, education, and communication campaign for all stakeholders. The department has also made mention that there will be no apprehensions yet.
“Even as RA 11229 is in place, we are DEFERRING the strict enforcement of the law. There will be no apprehensions yet. Rather, we will embark on an information campaign to drive home the point that this is all about SAFETY and that it must be practiced as part of our road discipline and safety culture.”
