EO Banning Use of Unregistered Vape in Public Signed

Last February 26, President Rodrigo Duterte signed Executive Order 106 that prohibits the use of unregistered vaping. It is amending the Executive Order 26 or the nationwide smoking ban which prohibits smoking in certain public places.

What is EO 106

Executive Order No. 106 (EO 106) is prohibiting the manufacture, distribution, marketing and sale of unregistered and/or adulterated electronic nicotine/Non-Nicotine Delivery Systems (END/ENNDS), Heated Tobacco Products (HTPs) and other novel tobacco products, amending Executive Order No. 26 and for other purposes.

Where to Secure License?

For establishments to secure a License to Operate (LTO), they can get it at the Food and Drug Administration (FDA). All e-liquids, solutions or refills forming components of ENDS/ENNDS or HTPs shall be registered with the FDA.

Designated Smoking / Vaping Area (DSVA)

Smoking and vaping is allowed in designated smoking and vaping areas. It can be an open space or a separate area with proper ventilation following the specific standard of the order.

Signages Needed at DSVA

  • Smoking/Vaping Area Signage
  • Graphic health warnings on the effects of using tobacco products, ENDS/ENNDS, and HTPs; and
  • Prohibition on the entry of the persons below 18 years old.

Non-Smoking / Vaping Buffer Zone (Buffer Zone)

A ventilated area between the door of a DSVA that is not located in an open space and the smoke/vape-free area is considered a buffer zome.  There must be no opening that will allow air to escape from the Buffer Zone to the smoke/vape-free area

Age Banned from using E-cigarette

As stated in the order, establishments are not allowed to sell vape/e-cigarettes and other tobacco products to 21 years old and below. Also, minors are not allowed to enter the DSVA and Buffer Zone.

Signages 

The Person-in-Charge must post and display “No/Smoking/Vaping” signage in locations where smoking is not allowed and it must be visible for the public to see.

Effectivity of Executive Order

The order will take effect 15 days after publication in a newspaper of general circulation.
